HMA vs SMA vs CRO — Understanding the Framework

Three different legal frameworks govern marriage registration in Delhi. Choosing the wrong route wastes time and money. The correct route depends entirely on your nationality, religion, and whether a ceremony has already taken place.

Fastest — 48 Hours

Hindu Marriage Act (HMA) — Tatkal

Available to Hindu, Buddhist, Jain, and Sikh couples who have already performed a religious ceremony. Both partners must be Indian nationals. Aadhaar-authenticated e-District filing with priority SDM appointment.

Standard — 30–35 Days

Special Marriage Act (SMA)

Applicable to inter-faith couples, foreign nationals, and couples without a prior religious ceremony. Mandatory 30-day notice period. No religion-based eligibility requirement. This route cannot be expedited.

Existing Certificate

Certificate of Registration (CRO)

Available where a valid religious marriage has already taken place and the couple needs to register a pre-existing marriage. Faster than SMA but requires proof of the prior ceremony — photographs, invitation, priest declaration.

e-District Workflow — How It Works

Step
1

Document Verification & Affidavit Drafting

We collect and verify all documents — Aadhaar, marriage photographs, ceremony proof, and age documents. We draft the required joint affidavit and individual affidavits on appropriate stamp paper. We confirm Aadhaar mobile linkage for both partners to ensure OTP-based e-District authentication works without delays.

Step
2

e-District Online Application (Aadhaar OTP)

We submit the Tatkal marriage registration application on Delhi's e-District portal using Aadhaar-authenticated OTP verification for both partners. The application includes all affidavits, photographs, ceremony proof, and fee payment. A properly submitted application receives SDM appointment confirmation within 24–48 hours.

Step
3

SDM Appointment — Both Partners & 3 Witnesses

Both partners and three witnesses attend the Sub-Divisional Magistrate's office on the appointed date. We accompany you to the appointment, handle all clerk interactions, and present documents in the correct sequence. The SDM verifies documents, records the registration, and issues a certificate acknowledgement on the same day.

Step
4

Marriage Certificate — Same Day or Next Working Day

The government-issued marriage certificate under the Hindu Marriage Act is typically issued on the same day as the SDM appointment or within one working day. This is the primary document for all subsequent uses — visa applications, name change, joint accounts, and MEA apostille for foreign use.

Who Can Be a Witness

Eligibility

Any Indian citizen above 21 years of age with valid government-issued photo ID. Does not need to be a family member or personally known to the couple.

🪪

Required ID

Aadhaar Card (preferred) or Passport. PAN Card alone is not accepted as witness ID at the SDM office. Voter ID may be accepted at some offices — confirm in advance.

📋

What They Do

Witnesses sign the marriage register and the witness declaration form at the SDM office. The process takes approximately 10 minutes. No prior preparation is required from witnesses.

Document Checklist

Both Partners

  • Aadhaar Card (original + photocopy) — must be mobile-linked
  • PAN Card
  • Age proof — Birth certificate or Class 10 Marksheet
  • 2 recent passport-size photographs each
  • Proof of address (Aadhaar / utility bill / rent agreement)
  • Individual affidavit of marital status (drafted by us)
  • Divorce decree (if previously married)
  • Death certificate of previous spouse (if applicable)

Marriage Ceremony Proof

  • Marriage photographs (minimum 4–6 clear photos of ceremony)
  • Wedding card / invitation
  • Priest declaration or purohit letter (where available)
  • Joint affidavit confirming ceremony took place (drafted by us)
  • Date and venue of ceremony must be consistent across all documents

Witnesses (3 Required)

  • Aadhaar Card or Passport — each witness
  • All 3 must be above 21 years of age
  • Must be physically present at SDM appointment
The most common rejection reason for Tatkal applications is inconsistency in the ceremony date across affidavits, photographs, and the wedding card. We review all documents for consistency before filing.

Frequently Asked Questions

Who is eligible for Tatkal marriage registration in Delhi?+
Tatkal registration under the Hindu Marriage Act is available to Hindu, Buddhist, Jain, and Sikh couples who have already performed a valid religious marriage ceremony. Both partners must be Indian nationals. At least one partner must have a Delhi address for the filing to be done at a Delhi SDM office.
How fast is Tatkal marriage registration actually?+
With complete documents and a correctly submitted e-District application, the SDM appointment is typically scheduled within 24–48 hours. On the appointment date, the certificate is issued the same day or within one working day. End to end, most Tatkal cases complete within 2–3 working days of engaging legal assistance.
Can we register if we haven't performed a religious ceremony yet?+
No. Tatkal registration under the Hindu Marriage Act requires a prior valid religious ceremony as a condition precedent. Without a religious ceremony, the applicable law is the Special Marriage Act, which has a mandatory 30-day notice period and cannot be expedited.
What is Aadhaar-authenticated e-District filing?+
Delhi's e-District portal requires Aadhaar-based OTP authentication for marriage registration applications. Both partners' Aadhaar numbers must be mobile-linked for the OTP to be received during online filing. If Aadhaar is not mobile-linked, the process requires an in-person biometric authentication step before the online application can proceed.
Who can be a witness for Tatkal registration?+
Three witnesses are required, each above 21 years of age. Witnesses must carry valid government-issued photo ID — Aadhaar or Passport. There is no requirement that witnesses be family members or personally known to either partner.
Can we use Tatkal registration for a visa application?+
Yes. The HMA marriage certificate obtained through Tatkal is a government-issued document fully valid for all immigration, visa, and OCI purposes. For foreign embassies, MEA apostille on the certificate is typically required.
What if one partner's Aadhaar shows a different state address?+
Only one partner needs a Delhi address for SDM jurisdiction. The other partner's Aadhaar can show a different state address without affecting the validity of the Delhi filing. We assess the address situation at the evaluation stage and advise on the correct SDM jurisdiction.
