What happens after receiving a SEBI summons?

Identify the investigation, provision, capacity in which the person is called, appearance date and records requested. Preserve trade, communication, device, bank, demat and decision records, then prepare a chronology that distinguishes raw facts from the inferences SEBI may draw.

How should a SEBI show-cause notice be answered?

Map every allegation to the disclosed material, statutory provision, transaction or communication, attributed role and proposed consequence. Preserve requests for inspection or additional material, factual objections and legal submissions for the hearing and any later appeal.

Can a SEBI interim or ex-parte order be challenged?

The route depends on the power invoked, urgency recorded, immediate restraint and procedural opportunity provided. A representation, request for modification, hearing, SAT appeal or other challenge may be considered according to the order and governing statute; timing is critical.

Can SEBI freeze a bank account or demat account?

Account and securities restrictions may arise through different interim, enforcement or recovery powers. The actual order, account, amount, depository or bank communication, statutory stage and forum for modification or appeal must be identified.

What evidence matters in insider trading, front-running or PFUTP allegations?

SEBI may analyse trades, order timing, price and volume patterns, relationships, access, communications, devices, bank flows and economic rationale. The defence should separate the underlying data from inferences about possession of information, connection, communication, intent or market effect.

Can WhatsApp, Telegram or other digital messages be used in a SEBI investigation?

Electronic communications may form part of the evidentiary record, but authorship, context, completeness, device access, timing and proof requirements remain important. Preserve native records and metadata rather than relying on selected screenshots or reconstructed chats.

Is SEBI settlement available after a show-cause notice?

Settlement is a separate eligibility- and timing-dependent route under the Settlement Proceedings Regulations. It is not available in every matter and should be compared with a contested response, immediate restrictions, collateral consequences and the stage of the proceeding.

What is the time limit for an appeal to the Securities Appellate Tribunal?

Section 15T provides the statutory appeal route and an ordinary filing period calculated from receipt of the qualifying order, with a limited power concerning delay. The exact order, service date, appealability and current procedural rules should be checked immediately.
